§ 1 General Provisions
1.1. These terms and conditions regulate the use of the online store at www.rgfk.pl.
1.2. The online store, operated under the address www.rgfk.pl (hereinafter: Online Store Rezystancja Grzejnika), is run by Rezystancja Grzejnika Filip Klich, registered in the Central Register and Information System for Business Activities NIP: 8971845968, REGON: 368408546 (hereinafter “Rezystancja Grzejnika”).

1.4. The terms and conditions of the Online Store Rezystancja Grzejnika are continuously available on the website www.rgfk.pl so that customers can access, store, and reproduce them. The terms and conditions are also made available to customers prior to the conclusion of a contract.
§ 2 Definitions
The terms used in these terms and conditions mean:
2.1. Consumer – a natural person within the meaning of Art. 221 of the Civil Code (BGB),
2.2. Service provider/Seller – Rezystancja Grzejnika Filip Klich, Opolska 11-19, 52-014 Wrocław
2.3. Online Store – the online store at www.rgfk.pl operated by Rezystancja Grzejnika Filip Klich
2.4. Civil Code – Act of 23 April 1964 (Dz.U. 1964 No. 16, item 93),
2.5. Goods and Services – all services provided and goods that are the subject of a sales agreement between the seller and the buyer,
2.6. Terms and Conditions – these terms and conditions for the provision of services electronically under Art. 8 of the Act on Electronic Services of 18 July 2002 (Dz.U. No. 144, item 1204),
2.7. Customer – a natural person, legal entity, or organizational unit without legal personality, to which special regulations grant legal capacity, who places or intends to place an order in the Online Store via electronic means,
2.8. Order – a declaration of intent by the Customer in which the Customer accepts the Seller’s sales offer, which includes in particular the price, type, and quantity of Goods or Services under the sales contract via the online store.
2.9. Consumer Rights Act – Act of 30 May 2014 on Consumer Rights (Dz.U. 2014 item 827).
§ 3 Use of the Online Store
3.1. The prices of all goods and services offered by the Store are gross prices and are expressed in Polish zloty. Deviations from the Polish currency are clearly indicated.
3.2. The prices and descriptions of goods and services on the website of the Online Store Rezystancja Grzejnika are for informational purposes only and do not constitute an offer under the Civil Code. They become legally binding for the conclusion of a specific contract only upon confirmation of the order acceptance by the Seller.
3.3. The Seller uses discount codes in the Online Store Rezystancja Grzejnika that authorize the purchase of goods with the discount stated on the coupon. Discount codes cannot be exchanged for cash.
3.4. Acceptance of these Terms and Conditions is required to place an order in the Online Store Rezystancja Grzejnika.
3.5. To successfully place an order in the Online Store Rezystancja Grzejnika, a device with internet access and a keyboard or another device allowing proper completion of electronic forms is required. It is recommended to use the latest versions of browsers: Firefox, Chrome, Internet Explorer, Microsoft Edge, Opera, Safari for OS X, etc.
3.6. The Store website uses Responsive Web Design (RWD) technology, which adapts the website content to the device on which it is displayed. The website is prepared for both desktop and mobile devices.
3.7. The website of the Online Store Rezystancja Grzejnika has an SSL certificate – a secure encryption protocol for communication.
§ 4 Conditions for Concluding a Sales Contract
4.1. Orders in the Online Store Rezystancja Grzejnika can be placed by filling out the appropriate forms available on the website.
4.2. The Customer is obliged to provide accurate personal data when placing an order: first and last name, address, email address, and mobile phone number.
4.3. Upon receiving the order, the Seller confirms receipt and simultaneously informs about acceptance of the order for processing. The confirmation is sent by email to the address provided in the order form. Upon confirmation of the order acceptance by the Seller, the contract is considered concluded.
4.4. The making available and recording of the contract content is done by providing these Terms and Conditions on the Online Store website and sending relevant information to the Customer’s email address provided in §4.2.
4.5. Orders in the Online Store Rezystancja Grzejnika can be placed 24 hours a day, all year round.
4.6. The delivery time is counted from the moment of successful payment authorization and does not exceed 4 business days.
§ 5 Payment Methods and Payment Deadlines
5.1. In the Rezystancja Grzejnika store, payment can be made in the following ways:
* Bank transfer to the Seller’s account,
* Cash on personal pickup,
* Via external payment service providers,
* By payment card.
5.2. After placing an order, the Customer receives the bank account number by email to transfer the appropriate amount. Once the payment is credited to the store’s account, the order is processed.
5.3. The Online Store allows payment using the following cards:
* Visa
* Visa Electron
* Mastercard
* MasterCard Electronic
* Maestro
5.4. The Online Store allows payments via the following external electronic payment systems:
* Tpay.com
* PayNow
5.5. The entity providing online card payment services is Blue Media S.A.
5.6. The Customer must make the payment using one of the above methods within 7 calendar days from the date of the sales contract conclusion.
§ 6 Delivery
6.1. Ordered goods are delivered exclusively within the EU and to the address provided by the Customer in the order form.
6.2. Delivery times are indicated on the Online Store website and are 24 hours on business days. The Seller will make every effort to deliver the goods within the time specified on the product page. If delivery within the specified time is impossible, the Buyer will be informed immediately.
6.3. Delivery of ordered goods is via:
* DPD
* Inpost
* FedEx
* GLS
* Poczta Polska
* Paczka w RUCHu
6.4. Upon handing over the goods to the courier company, the Buyer is notified via email.
6.5. The Customer may also collect the goods personally at the company’s headquarters. No delivery costs apply for personal collection.
6.6. Delivery costs in addition to the price of the goods are provided on the website at the time of ordering.
6.7. Upon receiving the goods, the Customer must confirm receipt. From this moment, the goods become the property of the Customer.
§ 7 Right of Withdrawal
7.1. Consumers who have concluded a distance contract or a contract outside business premises have the right to withdraw from the sales contract within 14 days of receiving the goods without giving any reason.
7.2. To exercise this right, the Buyer must inform the Seller by submitting a withdrawal statement on the form provided by the Seller, which may be sent by post to: Rezystancja Grzejnika Filip Klich, Opolska 11-19, 52-014 Wrocław; or electronically via the online withdrawal form sent to the seller’s email sklep@rgfk.pl. Sending the statement within the deadline is sufficient. Late statements have no legal effect.
7.3. The withdrawal form (Annex 1 of these Terms and Conditions) is provided electronically with the order confirmation.
7.4. If the withdrawal is submitted electronically via the form, the Seller will immediately send confirmation of receipt (on a durable data carrier within the meaning of Art. 2(4) of the Consumer Rights Act, Dz.U. 2017 item 683).
7.5. The cost of returning the goods, except in the cases specified in Art. 33 and Art. 34(2) of the Consumer Rights Act, is borne by the Seller.
7.6. The Buyer must properly secure the returned goods to prevent damage in transit. The Buyer bears the direct cost of returning the goods.
7.7. The return must be made immediately, but no later than within 14 days from the date of withdrawal. The Seller may require the goods to be collected by him or an authorized person.
7.8. If the delivered goods are incomplete or show signs of use beyond normal handling, the Seller reserves the right to reduce the refund accordingly.
7.9. In case of withdrawal, all payments, including delivery costs, will be refunded immediately, but no later than 14 days after receiving the withdrawal statement.
7.10. The refund is made using the same payment method used by the Buyer, unless otherwise agreed without additional costs.
7.11. The right of withdrawal does not apply to contracts specified in Art. 38 of the Consumer Rights Act.
7.12. By concluding the contract, the Buyer confirms that he/she has read these Terms and Conditions and is aware of the withdrawal rights.
§ 8 Complaints
8.1. If the Buyer finds defects in the goods after the transfer of ownership, he/she may:
- as a consumer (Art. 22 §1 BGB) submit a warranty claim,
- as a non-consumer submit a warranty claim.
8.2. In case of mechanical damage during delivery or to file a complaint, the Buyer should notify the Seller by mail or email, indicating the defect, date of occurrence, desired remedy, and contact details. Lack of information does not affect the effectiveness of the complaint.
8.3. The Seller will respond within 14 days. Failure to respond within this period means the complaint is considered justified.
8.4. The Seller informs about out-of-court dispute resolution options, including mediation or arbitration. Consumers can also use the EU ODR platform.
§ 9 Personal Data
9.1. The Seller is the administrator of personal data. Detailed information about data processing, recipients, and legal bases is available in the Privacy Policy in accordance with GDPR.
9.2. The Privacy Policy is available on www.rgfk.pl.
9.3. Purpose of processing Customer data is order fulfillment. Legal bases: sales contract or pre-contractual actions (Art. 6(1)(b) GDPR), legal accounting obligations (Art. 6(1)(c) GDPR), and legitimate interest of the Seller for claims (Art. 6(1)(f) GDPR).
§ 10 Final Provisions
10.1. The Seller reserves the right to make changes to these Terms and Conditions for valid reasons. Changes take effect at the date indicated by the Seller, but not earlier than 7 days.
10.2. Changed Terms and Conditions are binding if Art. 384 and 384[1] BGB are observed, i.e., proper notification and no termination within 14 calendar days.
10.3. Website users must not post illegal content (Art. 8(3)(b) of the Electronic Services Act of 18 July 2002, Dz.U. 2017 item 1219).
10.4. For matters not covered by these Terms, the Civil Code and Consumer Rights Act of 30 May 2014 apply.

10.6. Contracts with the Seller are concluded in Polish.
10.7. These Terms and Conditions come into force on 09.03.2020.
